ABOUT US

Caretown is a native mobile application compatible on both Android and iOS that is designed for caregivers of Medly for Heart Failure patients (“care partner”) to support disease co-management. Following the care partner’s consent, Caretown connects with the Medly product to retrieve care partner data and display it in a read-only format for informal caregivers such as family and friends to monitor, provide caregivers with symptom management tips, provide a messaging platform where caregivers can connect with their care partner’s professional healthcare team, and house a suite of vetted and evidence-based resources. It is not a medical device and is not designed for use without the supervision of a trained medical practitioner. Nothing contained in the App should be construed, directly or indirectly, as the practice of medicine or providing medical advice or medical services by UHN. The App is not intended to diagnose, cure, mitigate, treat or prevent disease or other conditions.

REGULATORY

Caretown is considered not a medical device and regulatory licensing is not required. It will be distributed in Canada.

B. END USER LICENSE AGREEMENT

Please read the following End User License Agreement (“EULA”), including all disclaimers and terms and conditions of use below, carefully before using the App. By using or accessing this App you acknowledge that you have read, understood and accepted the disclaimers and terms and conditions of use contained in this EULA. If you do not accept any of these disclaimers or terms and conditions, you must not use the App.

Information in this App has been developed by UHN.

  1. DISCLAIMER: UNIVERSITY HEALTH NETWORK MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OF THE INFORMATION PROVIDED. THE INFORMATION CONTAINED IN OR PRESENTED FROM THE APP IS EXCLUSIVELY INTENDED FOR EDUCATIONAL PURPOSES AND COMES WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED.   3. Governing Law and Jurisdiction. This EULA shall be interpreted under, and any action or claim arising from or related to the App shall be brought in the courts of, and governed exclusively by, the laws of Ontario, Canada and the applicable laws of Canada applicable therein, without regard to its conflicts of laws principles. Unless prohibited by applicable law, you expressly waive the right to participate in a class action proceeding.

  4. Changes and Updates. UHN reserves the right to update or change information contained in the App without prior notice or prior acceptance.

  5. Not Medical Advice. The App is not a substitute for your care partner’s professional medical advice, diagnosis or treatment. Never make changes to your care partner’s medication, nor adjust their dose. Always seek the advice of a physician or other qualified healthcare providers concerning questions you have regarding your care partner’s medical condition, and before starting, stopping or modifying any treatment or medication. Never delay obtaining medical advice or disregard medical advice for your care partner because of something you have or have not read on the App. If your care partner has, or if you suspect they have, a health problem, or if they experience an adverse side effect, please consult their doctor. If your care partner has, or you suspect they are experiencing a health emergency, please call 911 and/or promptly have them visit a Hospital Emergency Department nearby.

  6. No Regulatory Approval. The App has not been evaluated by Health Canada, the United States Food and Drug Administration (“USFDA”) or any other domestic or foreign regulatory agency and is not approved to diagnose, treat, cure or prevent any disease or for the prescription of any medication or treatment. While the information contained may be of use in other jurisdictions, these materials were provided and designed for use in Canada and you are solely responsible for ensuring suitability and permitted use in other jurisdictions.

  8. Express Consent to Receiving Electronic Messages from UHN. By using the App, I hereby expressly consent to receiving electronic messages from UHN, including alerts and reminders, information, notifications, requests for your feedback, commercial messages, and other important communications from UHN and its programs and other UHN offerings.

C. COLLECTION OF DATA

  1. Transmission of non-identifying data to UHN. We collect non-personally identifiable data (which is transmitted back to us) through the App regarding the use of the App in order to better understand use of the App and to help us identify areas for improvement. If you do not consent to the transmission of this data to UHN, then you must not use the App.

  2. Transmission of Identifying Data and PHI. The use of the App requires all users to be paired with a Medly patient (“care partner”). This pairing allows for the transmission of the care partner and user’s PHI (name, contact information, relation between user and care partner) in addition to the medical PHI for the care partner to the App. Data on the use of the application is also collected in tandem with user identifying data (email address) to discover trends and opportunities for improvement. If you do not consent to the transmission of this data to UHN, then you must not use the App.

  3. DISCLAIMER. THE APP TRANSMITS YOUR PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION OVER THE INTERNET. INFORMATION TRANSMITTED OVER THE INTERNET MAY BE AT RISK OF INADVERTENT LOSS OR THEFT. UHN CANNOT GUARANTEE THE SECURITY OF ANY INFORMATION TRANSMITTED TO OR FROM THE APP. BY USING THE APP, YOU AGREE THAT YOUR ACCESS AND USE OF THE APP AND THE CONTENT, INCLUDING BUT NOT LIMITED TO PERSONAL INFORMATION AND PERSONAL HEALTH INFORMATION, IS ENTIRELY AT YOUR OWN RISK AND LIABILITY.

D. LIMITED LICENSE

Through your purchase or download, provided that you comply with the terms of this EULA, you are acquiring and UHN grants you a personal, limited, non-exclusive and non-transferable license to install and use the App on your device for personal, non-commercial use and subject to any usage rules set forth by the distributor. This EULA does not entitle you to receive from UHN hard-copy documentation, support, telephone assistance or enhancements or updates to the App.

PRIVACY POLICY

This privacy policy governs your use of the software application Caretown for mobile devices that was created by the Centre for Digital Therapeutics, University Health Network (UHN). Caretown is a smartphone app designed to support caregivers of Medly patients to co-manage heart failure. Following care partner consent, Caretown connects with the Medly product to retrieve patient data and display it in a read-only format for informal caregivers such as family and friends to monitor, provide caregivers with symptom management tips, display data trends, provide a messaging platform where caregivers can connect with the care partner's professional healthcare team, and house a suite of vetted and evidence-based resources. Caretown It is not intended to replace the Medly patient’s current care, but to supplement it with additional support.

What information does the Application collect and how is it used?

User Provided Information

The App obtains the information you provide when you download and register for the Application via the Medly Dashboard.

When you register with us and use the Application, you generally provide the Medly team with an email address and other registration information; (a) first and last name , (b) care partner’s first and last name, (c) phone number, (d) relationship to the care partner, (e) whether you reside with the care partner or not (optional) and (f) information you provide us when you contact us for technical help with the application. While most of the registration information is solely used for account creation and contact purposes, the relationship with the care partner and whether you reside with them will be used for research purposes. The research team may also use your contact information (phone or email) to share important information about the app and required updates.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. This information is collected for analytics.

Does the Application collect precise real time location information of the device?

This Application does not collect precise information about the location of your mobile device. 

Do third parties see and/or have access to information obtained by the Application?

Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Application and our service. We will share your information with third parties only in the ways that are described in this privacy statement. 

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena, or similar legal process;

  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement and the Personal Health Information Protection Act, 2004 and any subsequent Amendments.

Use of your Information by your care partner’s Healthcare Team

The information collected by the App will not be provided to your care partner’s healthcare team and is not part of their medical record.

What are my rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application. For the purposes of the research trial, your data will be stored for 10 years as per the Records Retention Policy.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain.

For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via the application. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
